The Practice of Khiyar in Online Transaction (A Case Study of Rayy Scarf)
Abstract
Khiyar is the option to rescind or finalize a contract for either the seller or the buyer. In face-to-face transactions, buyers can inspect the items they wish to purchase without limitations, whereas in online transactions, buyers face constraints in inspecting their ordered goods. The existence of the khiyar right between seller and buyer aims to ensure that the buyer does not feel disadvantaged or deceived. This study is the first to examine Rayy Scarf, an online fashion store. It aims to determine the practice of khiyar and the perspective of Islamic law on the practice of khiyar at the Rayy Scarf online store. This study employed a descriptive qualitative method with a field research approach. The results show that the practice of khiyar 'aib (option for defect) exists at Rayy Scarf. When a buyer receives a defective or non-conforming item, the seller offers the option to exchange the purchased item for a similar one or one of equivalent value. This practice of khiyar is permissible under Islamic law.
